1. Introduction

These Terms of Service ("Terms") govern the provision of land surveying services by Tribach Ltd ("we", "our", "us") to you, the client ("you", "your"). By engaging our services, you agree to be bound by these Terms.

2. Services

We provide land surveying services as detailed in our proposal or agreement with you. Our services are provided in accordance with the standards set by the Royal Institution of Chartered Surveyors (RICS) and applicable UK laws and regulations.

3. Client Responsibilities

You agree to:

• Provide us with all necessary information and access to the property to be surveyed.
• Ensure that all information provided is accurate and complete.
• Obtain any necessary permissions or consents for us to access and survey the property.
• Pay our fees as agreed and within the specified timeframe.

4. Fees and Payment

Our fees will be as set out in our proposal or agreement. Unless otherwise stated, all fees are exclusive of VAT. Payment is due within 30 days of invoice date. We reserve the right to charge interest on late payments at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998.

5. Intellectual Property

All intellectual property rights in our surveys, reports, and other deliverables shall remain our property. Upon full payment of our fees, you will be granted a non-exclusive, non-transferable licence to use the deliverables for the purpose for which they were commissioned.

6. Limitation of Liability

Our liability for any loss or damage arising out of or in connection with our services shall be limited to the amount of our professional indemnity insurance cover. We shall not be liable for any indirect or consequential loss or damage.

7. Confidentiality

We will keep confidential all information provided by you or obtained during the course of our work, except where disclosure is required by law or regulatory bodies, or where you give us permission to disclose.

8. Data Protection

We will process any personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and our Privacy Policy.

9. Termination

Either party may terminate the agreement by giving 30 days' written notice. In the event of termination, you will be responsible for paying for all work completed up to the date of termination.

10. Force Majeure

Neither party shall be liable for any delay or failure to perform its obligations due to events beyond its reasonable control.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website.
